Terms of Service

Agreement

By downloading, installing, or using the Radiophonia application (“the App”) or accessing the radiophonia.app website (“the Website”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the App or Website.

These Terms constitute a legal agreement between you and Gibbsoft Ltd (“we”, “us”, “our”), a company registered in England and Wales.

What Radiophonia does

Radiophonia is an internet radio player and personal listening tool. It allows you to:

• Browse, search, and play internet radio stations from publicly available directories.
• View and search your personal listening history.
• Save favourite stations and sync them across devices (optional).
• Play local audio files stored on your device.
• Set radio alarm clocks and sleep timers.

Radiophonia is an aggregator and player. We do not broadcast, produce, or control the content of any radio station. Stations are provided by independent third-party operators via publicly available streams.

Radio station content

All radio station content — including music, speech, and advertisements within streams — is the responsibility of the respective station operators. We do not endorse, verify, or assume liability for any content broadcast by third-party stations.

Station availability, stream quality, and metadata accuracy depend on the station operators and the RadioBrowser community directory. Stations may become unavailable, change URL, or alter their content without notice.

If you believe a station is broadcasting content that infringes your rights, please contact the station operator directly. If you believe a station listing should be removed from the RadioBrowser directory, you may report it to radio-browser.info.

Your account

Accounts are optional. You may use the App without creating an account.

If you create an account, you are responsible for maintaining the security of your sign-in credentials. You agree to notify us promptly if you become aware of any unauthorised use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

Acceptable use

You agree not to:

• Use the App to rebroadcast, redistribute, or publicly perform radio streams without the station operator’s permission.
• Attempt to circumvent any technical measures in the App.
• Use the App in any way that violates applicable laws or regulations.
• Reverse-engineer, decompile, or disassemble the App, except to the extent permitted by applicable law.

Intellectual property

The Radiophonia name, logo, and application code are the property of Gibbsoft Ltd. All rights reserved.

Song titles, artist names, album artwork, and other metadata displayed in the App are the property of their respective rights holders and are retrieved from third-party services (iTunes, MusicBrainz) for informational purposes only.

Your data

Your listening history, favourites, and preferences belong to you. You can export your history as CSV at any time. If you delete your account, all synced data is permanently removed. See our Privacy Policy for full details.

Availability and changes

We aim to keep the App and Website available, but we do not guarantee uninterrupted access. We may update, modify, or discontinue features at any time.

We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent revision. Continued use of the App or Website after changes constitutes acceptance of the updated Terms.

Disclaimer

The App and Website are provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

• The App will be error-free or uninterrupted.
• Radio streams will be available, accurate, or of any particular quality.
• Metadata (song titles, artist names, artwork) will be complete or correct.

Limitation of liability

To the maximum extent permitted by law, Gibbsoft Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App or Website.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

Governing law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
